In November 2025, Congress passed a spending bill with a provision called Section 781 tucked inside. It rewrites the federal definition of hemp. The President signed it on November 12, 2025, with a one year delay before it takes effect.
The new definition caps total THC at 0.4 milligrams per container. Full spectrum CBD, the kind that does not get you high, naturally contains trace THC. Industry estimates say roughly 90 percent of CBD products on shelves today would exceed the cap.
That is the day the new definition becomes enforceable. Unless Congress passes a fix first, products that are legal today, tested, labeled, and sold responsibly, become federally unlawful that morning.
The bipartisan Lawful Hemp Protection Act would replace the ban with a national regulatory framework: labeling standards, age restrictions, product safety rules, and American sourcing. Congress does not need to invent the answer. It needs to hear that we want it passed.
